CANCELLATION & REFUND POLICY:

We understand that sometimes plans change. To allow us to cover the costs of organising the retreat and give us enough notice to potentially offer your place to someone else, the following cancellation policy applies:

8 or more days before the retreat: You will receive a 50% refund of your booking fee.

7 days or less before the retreat: No refund is available for cancellations.

By booking your place, you acknowledge and agree to these cancellation and refund terms.

Acknowledgment of risk

1. Inherent risks — skateboarding — Skate training involves inherent risks including but not limited to: falls on hard concrete or other hard surfaces, loss of board control, collisions with other participants or fixed structures, overexertion, sprains, fractures, head injuries or abrasions resulting from contact with the skate surface or equipment. Performing tricks, navigating transitions and operating a skate all increase the likelihood of falls. These risks exist even when proper technique and safety gear are used and may result in serious injury or death.

2. Inherent risks — ocean swimming — Ocean swimming involves inherent risks including but not limited to: powerful waves and whitewater, rip currents and lateral currents, submerged rocks, sand bars and other underwater hazards, sunburn and heat-related illness, contact with marine life including jellyfish, stingrays, bluebottles, and sharks and rapidly changing weather and sea conditions. Ocean environments are unpredictable and conditions may deteriorate without warning. These risks may result in serious injury or death.

3. Voluntary participation — I voluntarily choose to participate in Belvista Studios PTY LTD activities, fully understanding the potential risks. I am in good health, physically fit to participate and have no medical conditions that would prevent me from safely taking part. 

4. Safety gear & equipment — For skateboarding I agree to wear a helmet, knee pads, elbow pads and wrist guards at all times. I am aware that wearing safety gear reduces but does not eliminate the risk of injury.

5. Instructor authority — I agree to follow all instructions from Belvista Studios PTY LTD instructors and helpers at all times, including any decision to cancel, delay or modify a session due to unsafe conditions.

6. Personal responsibility — I acknowledge that it is my responsibility to communicate any medical conditions, injuries or concerns to my instructor prior to arrival and each lesson and/or session. I will exercise caution at all times and will not engage in reckless behaviour that could endanger myself or others, whether in the skate locations, in the water, on the beach and/or other locations you visit. I acknowledge that it is my responsibility for my safety and wellbeing at all times.

Waiver and release of liability

1. Release of liability — I release, waive and discharge Belvista Studios PTY LTD, its owners, employees, instructors, agents, helpers and affiliates from any and all liability, claims or causes of action arising out of any loss, damage, injury or death sustained while participating in training, participation or on the premises.

2. Indemnification — I agree to indemnify and hold harmless Belvista Studios PTY LTD and its affiliates from any claims brought against them by any third party as a result of my actions during training and participation.

3. Medical treatment — I am responsible for any associated costs.

AGREEMENT & SIGNATURE

I have read and fully understand this Waiver and Release of Liability, which covers all Belvista Studios PTY LTD activities including skateboarding. By submitting this form, I acknowledge I am voluntarily giving up certain legal rights, including the right to sue Belvista Studios PTY LTD or its affiliates. I submit this form voluntarily and without any inducement.
